US Judge Mandates Freedom of Abrego Garcia from Immigration Detention

Legal scene

A federal judge has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement lacks lawful basis.

"Since his release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her order.

The case originates in a erroneous deportation to El Salvador in March, which US authorities later acknowledged was an error. Following his return to the United States to face alien smuggling charges, he was held in federal detention.

In her decision, the court pointed out that the government lacks a valid deportation order, which prevents them from removing Mr. Abrego Garcia "for now."

Context of the Case

The court proceedings involve disputed claims. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this claim.

He has also entered a not guilty plea to the smuggling charges, which are part of a ongoing trial in Tennessee.

Conditions of Freedom

The court, who was hearing his challenge to deportation in a Maryland district court, determined that he must now adhere to the terms of his bond from custody in Tennessee. This decision effectively transfers his supervision to the jurisdiction handling his criminal case.

This decision marks a notable turn in a complex legal case featuring allegations of mistaken imprisonment and disputed criminal associations.
